Weber, Hodges & Godwin v. Cook
Martin & Gifford, PLLC has successfully litigated claims for real estate commissions. One example is the case of Weber, Hodges & Godwin Commercial Real Estate Services, LLC vs. John and Rose Cook. In that case, we represented a commercial real estate firm in Boone that entered into an exclusive listing agreement to sell a parcel of raw land. Our client believed that it was entitled to its full commission even though the listed property was not sold until several weeks after the expiration of the firm’s listing agreement, and even though our client had no contact with the ultimate buyer. When the landowner refused our demand for compensation, we filed suit and eventually presented the case to a Watauga County jury. The jury awarded our client its full commission of approximately $180,000.
When the defendants appealed the trial court’s judgment to the North Carolina Court of Appeals, and later to the North Carolina Supreme Court, we prepared and filed the legal briefs that resulted in the trial court’s judgment being affirmed in all respects.
